Terms of Service (Diamoniaga Trading)

These Terms of Service (“Terms”) govern your access to and use of the Diamoniaga Trading website (“Site”) and any purchases made through it. By accessing the Site or placing an order, you agree to these Terms.

1) About Us

2) Eligibility

You must be legally capable of entering a binding contract under applicable law. If you use the Site on behalf of an entity, you represent you are authorised to bind that entity.

3) Products & Listings (Live Inventory)

Our listings may reflect live supplier inventory and market pricing. Availability, pricing, and specifications may change at any time without notice. Images are for illustration; actual appearance may vary.

4) Pricing, Currency & Payment

Prices are shown in [MYR/USD] unless stated otherwise. Payment must be received in full before an order is confirmed. We may use third-party payment processors; their terms may apply.

5) Order Acceptance & Cancellation

Submitting an order does not guarantee acceptance. We may accept, decline, or cancel an order at our discretion (including for suspected fraud, pricing errors, or supplier unavailability).
If an order is cancelled before shipment due to unavailability or error, we will provide a refund in accordance with our Returns & Refund Policy.

6) Certification, Grading & Disclosures

Where a diamond is sold with a certificate (e.g., GIA/IGI/other labs), certification details are provided by the issuing laboratory. Variations may occur due to lighting, settings, and individual perception. We do not independently re-grade third-party lab reports unless expressly stated.

7) Custom/Commission Work (If Applicable)

If you purchase any customised, resized, engraved, or made-to-order goods (including ring settings), additional lead times may apply and orders may be non-cancellable once work begins, except as required by applicable law. Any such terms will be stated at checkout or in writing.

8) Shipping & Delivery

Shipping is governed by our Shipping Policy. Delivery timelines are estimates only. Title and risk may pass according to the Shipping Policy and applicable law. We are not responsible for carrier delays, customs holds, or events beyond our control.

9) Insurance & Claims (Best Efforts)

We will use best efforts to arrange insured shipping where reasonably available and commercially practicable. Insurance availability and coverage are subject to carrier/insurer rules and destination restrictions.
Where insurance applies, claim outcomes are determined solely by the carrier/insurer. We may assist with documentation, but we do not control claim decisions or timelines.

10) Returns, Refunds & Exchanges

All returns and refunds are governed by our Returns & Refund Policy, which forms part of these Terms.

11) User Conduct

You agree not to:

  • misuse the Site or interfere with its operation,

  • attempt unauthorised access to systems/accounts,

  • use the Site for unlawful, fraudulent, or harmful activity,

  • infringe the rights of others.

12) Intellectual Property

All Site content (text, images, logos, layout) is owned by or licensed to us and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute Site content without our written permission, except for personal, non-commercial use.

13) Accuracy of Information

We try to keep information accurate, but we do not warrant that product descriptions, pricing, availability, or any content is complete, current, or error-free. We reserve the right to correct errors and update information at any time.

The Site may contain links to third-party websites or services. We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

15) Disclaimer of Warranties

To the maximum extent permitted by law, the Site and products are provided on an “as is” and “as available” basis. We disclaim all warranties not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

16) Limitation of Liability

To the maximum extent permitted by law:

  • We will not be liable for indirect, incidental, special, consequential, or punitive damages (including loss of profit, data, goodwill, or business interruption).

  • Our total aggregate liability arising from or relating to the Site, any order, or these Terms will not exceed the amount paid to us for the relevant order giving rise to the claim.
    Nothing in these Terms limits liability that cannot be excluded under applicable law.

17) Indemnity

You agree to indemnify and hold us harmless from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Site, or violation of any law or third-party rights.

18) Force Majeure

We are not responsible for any failure or delay caused by events beyond our reasonable control (including carrier disruptions, strikes, natural disasters, security incidents, governmental actions, or power/telecom outages).

Your use of the Site is also subject to our Privacy Policy. By using the Site, you consent to our collection and use of information as described there.

20) Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted on the Site with a new effective date. Continued use of the Site after changes means you accept the updated Terms.

21) Governing Law & Disputes

These Terms are governed by the laws of Malaysia. You agree to submit to the courts of Malaysia (and where appropriate, the courts of Kuala Lumpur) unless mandatory consumer laws in your jurisdiction require otherwise.

22) Severability

If any provision is found unlawful or unenforceable, the remaining provisions remain in effect.

23) Entire Agreement

These Terms, together with our Shipping Policy, Returns & Refund Policy, and Privacy Policy, constitute the entire agreement between you and us relating to the Site and purchases.
